Privacy Policy

We strive to make your online experience with Incubate Messenger, Inc. (“Incubate”) secure and satisfying.  This Privacy Policy describes and governs what information we gather from you, how we use that information, and what we do to protect it when you use our websites, mobile applications and other online products and services (collectively, the “Services”). By using Incubate, you expressly consent to the information handling practices described in this Policy.  If you do not want information about you to be used in the manner set forth in this Privacy Policy, please do not use Incubate.  We may change this Privacy Policy from time to time.  We encourage you to review the Privacy Policy whenever you access the Services to stay informed about our information practices and the ways you can help protect your privacy.  If changes are made to the Policy, we will notify you by adjusting the date at the top of the policy and may send you a notification.  Your continued use of the Services constitutes your agreement to this Policy and future revisions.

 

Collection of Information

We collect information you provide directly to us. For example, we collect information when you create an account, use the Services to send or receive messages, including photos or videos taken or delivered via our Services, request customer support or otherwise communicate with us. The types of information we may collect include your username, password, email address, phone number, age and any other information you choose to provide.  If you choose to provide such information, you are giving us permission to use and store that information consistent with this Policy.

We may store your phone number, as well as information regarding your mobile device, including your mobile phone number, device type and operating system and information in your mobile phone's address book or in other applications as permitted by the functionality of such mobile device.  Additionally, Incubate will automatically collect data about each message, such as the sender, recipient, date and time a user utilizes the Services, along with the number of messages sent and received and with whom you interacted most often.  When you send or receive messages, we also collect, process and store the contents of those messages (such as texts, voice, photos, videos and captions) on our servers as a support mechanism in the event of a system/delivery failure or user device modification. The contents of those messages are also stored on the devices of recipients.  When using our website, we log your IP address, content and pages viewed, access times, browser type and links from other sites that led you to our site.  We also may send cookies – small data files stored on your computer or mobile device – to your computer to track user visits and other traffic patterns. Finally, with your consent, we may collect information about the location of your device to facilitate your use of certain features of our Services.

 

Collection of Information from Other Sources

We may also collect information from other sources and combine it with the information we have obtained through our Services in order to enhance the quality of our Services.

 

Use of Information Collected

We may use the information that you provide or we collect for various purposes, including operating, maintaining and improving our Services by updating our features and content for your messages.  We use all information collected from users to understand and analyze usage trends and user preferences, improve the design and functionality of the Services and create new features.  Automatically collected data may be used to: 1) remember your information to ease re-entry; 2) personalize the Services for the user; 3) send technical notices, updates or security alerts; 4) communicate updates, technical notices or security alerts via email, text or in-app communication; 5) monitor participation or user activity; 6) detect and prevent fraudulent activity; and 7) carry out other purposes for which the information was collected.

Incubate is based in the United States and the information we collect is governed by the laws of the United States. By accessing or using the Services or otherwise providing information to us, you consent to the processing and transfer of information in and to the U.S.

 

Disclosure of Information

We may disclose information with other users when you send them messages, including your username and the contents of the message sent.  Further, when a user uses the Address Book or Search option to add friends, your username will be shared with those who have your phone number in their contacts list.  We may also share personally identifiable information with outside vendors, contractors, consultants or other agents who assist us with carrying out work on our behalf.  

We may disclose personally identifiable information if required to do so by law or under the good faith belief that such action is necessary to comply with local, state or federal law, rule or regulation (including, without limitation, U.S. copyright or trademark law) or respond to a court order, subpoena, judicial or other governmental requirement or warrant in a manner required by the requesting party.  We may also share information in order to investigate or prevent potential violations of our user agreements or policies, or take necessary precautions against liability or to protect the rights, property and safety of Incubate and its users. 

Finally, in the event that negotiations of or any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company occurs, information may be shared in connection with this development.  

 

Personal Access

Upon registration as a member of Incubate, we take reasonable steps to verify your identity prior to granting you account access or making corrections to your information in order to protect your privacy and security.  It is the sole responsibility of the user to protect the secrecy of your password and account information at all times. 

 

Security

We use commercially reasonable measures and safeguards to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction.  We cannot, however, guarantee or warrant the security of any information you transmit to Incubate – please do so at your own risk.

 

Children

Incubate does not knowingly collect personal information from users under the age of 13.  We do, however, allow parents to create accounts for children under the age of thirteen by using the Nursery to serve as a place-holder for Incubate messages until the child has reached the requisite age of consent.  If we learn that personally identifiable information of a person under the age of 13 years has been collected, we will take appropriate steps to remove this information.

 

Nursery

A parent or legal guardian may create an Incubate account for a child under the age of 13 through a unique email address that the parent has assigned for the child.  The parent or legal guardian may then use the Services to create content and distribute it to that address until the child has reached the requisite age of consent.  We intend to only collect the email address and content to fully perform the Services.

 

Settings

Through settings in our Services, you can choose whether to accept friend requests or request friends from your contact list.  You have the ability to delete users from your friends list and deny friend requests at any time.  You may update your account information by editing your account settings on the settings page.  You can also delete your account at any time.

 

Incubate requests access to your device’s address book and microphone in order for the Services to reach optimum functionality.  If you choose to search friends, the names and devices in your address book will be transmitted to Incubate.  You may revoke consent at any time by changing the settings on your device or by removing our Services from your device.  

 

Finally, Incubate may send push notifications or alerts to your device.  You can prevent these messages at any time by changing the notification settings on your device or within the settings page in our Services.
